Changes in personal data protection legislation

On January 13, 2012 the Law of Ukraine “On Amendments to Final Provisions of the Law of Ukraine “On Amendments to Certain Laws of Ukraine Regarding Increase of Liability for Violation of the Personal Data Protection Law” (the Law) was adopted. Pursuant to the new Law the amendments to the Code of Administrative Offences of Ukraine and to the Criminal Code of Ukraine introducing administrative and criminal liability for violations of the laws on personal data protection will come into force as of 1 July

2012. The New Law shall come into force as of its official publishing. It shall be reminded that amendments to the Code of Administrative Offences of Ukraine and to the Criminal Code of Ukraine were made due to enactment of the Law of Ukraine “On Personal Data Protection” and came into force as of 1 January 2012. After enactment of the new Law enactment of mentioned amendments will be postponed till 1 July 2012.

Also on January 3, 2012 the Ministry of Justice of Ukraine registered the decree “On Approval of the Standard Procedure for Processing of Personal Data in Personal Data Bases”.

The Standard Procedure was approved pursuant to the Law of Ukraine “On Personal Data Protection” and determines general requirements to organizational and technical measures of protection of personal data in course of data processing in personal data bases.
